EVV has been mandated for the state of Washington for home health care services. As of the implementation 2024 implementation date, Electronic visit verification is required for all homecare services administered within the state. When is the official start date?  What specific types of care and organizations does it apply to, and what are the requirements? Are agencies free to use any EVV software provider system? Washington Electronic Visit Verification Information

Nationwide EVV mandates were created out of a need for coordinated compliance with the requirements established within the 21st Century Cures Act. The Federal 21st Century Cures Act (2016) required that U.S. states including Washington State, implement an electronic visit verification (EVV) system for agencies delivering certain types of care (home health care and personal care services although some states require EVV for additional types of care as well). Electronic Visit Verification (EVV) software by definition is a system designed to electronically capture and verify provider visit information.

When does EVV start in Washington State?

The official implementation date was January 1, 2024

What is EVV and what are the requirements?

Beginning on January 1, 2024, there are three new required data elements for electronic visit verification within the state. These data elements align with the requirements set forth by the 21st Century Cures Act. These data element requirements include:

  • Type of service performed 
  • The individual receiving the service 
  • Date the service was performed
  • The location of service delivery 
  • The individual providing the service 
  • The time the service begins and ends 

The Washington state HCA requires that the data elements be submitted with the claim either via direct data entry (DDE) or the 837i. The data elements indicated as “existing” are currently required and Home Health agencies are submitting those currently. The data elements indicated as “new” are the new requirements for Home Health agencies to include in claims submittals.

What agencies in the state are required to use EVV?

In the state of Washington, any care worker providing personal care and/or respite care services funded by Medicaid payments for a client who lives in a home or private residence environment (excluding institutional, residential, or hospital care settings) and receives payments for these in-home care services must use a compliant and compatible Electronic Visit Verification system for Washington .

  • This includes the employees of both Home Care Agencies and the Consumer Directed Employer (CDE), who is the legal employer of all Individual Providers (IP) in the state of Washington which was effective as of 6/1/2022. 
  • Individual Providers, employed by the CDE, who Live WITH their clients are not required to use EVV (This exception doesn’t apply to contracted Home Care Agency employees and caregiving staff. All Home Care Agency caregiving employees must use EVV for shifts worked).
  • If you do NOT live with your client, you must use EVV. The required data elements must be captured at the time of service provision, and included with claims submissions sent by the employing agency, whether it is the CDE or another Home Care Agency. EVV for HHCS Providers

The Health Care Authority is providing the following guidance for MCOs regarding electronic visit verification (EVV) for home health care services (HHCS).

The HCA will not begin denying claims and rejecting encounters without the EVV HHCS data on 1/1/2024 . There will be a period of technical assistance for providers to come into compliance with EVV HHCS requirements, including enrolling individual HHCS providers with HCA.

MCOs should not deny EVV HHCS claims that do not have all the required EVV data elements with service dates starting 1/1/2024, as stipulated under 9.15.15 of the upcoming amendment to the MCO contract. Initially, there will be a period of technical assistance for providers to become compliant with EVV requirements. HCA will give notice to MCOs for when to begin denying claims without the required data.

MCOs must have their systems ready by 1/1/2024 to begin collecting EVV data elements on claims submitted by providers and send EVV HHCS data to HCA on encounters as detailed in the EDRG and companion guides. This is necessary for HCA’s EVV HHCS reporting requirements to CMS, for HCA to monitor the number of claims without EVV HHCS data, and to identify which providers are not submitting EVV HHCS data.

HCA will perform outreach to those providers not sending the EVV data elements and requests the MCOs also perform outreach and provide support to providers not meeting EVV HHCS requirements starting 1/1/2024.

This information will be incorporated into the EVV HHCS FAQs on the HCA’s EVV HHCS website in the upcoming days. You’ll be notified as to when this has been updated.

EVV Compliance Status for Personal Care Services by State or Territory

This table lists each state or territory’s compliance status with Electronic Visit Verification (EVV) requirements as of January 1, 2021 for personal care services. States and territories were required to self-report their EVV implementation status using a web-based survey, which the Centers for Medicare & Medicaid Services (CMS) used to determine compliance with the EVV requirements included in Section 12006(a) of the 21st Century Cures Act. The table indicates whether each state or territory reported it was fully compliant, partially compliant, or not compliant with EVV requirements as of January 1, 2021.   • What Is State Electronic Visit Verification?

Electronic Visit Verification (EVV) is an electronic timekeeping system used to verify when an employee arrives and departs from the client home. If your agency provides services for state-run programs, you may be required by the state to use a specific state-approved EVV system and/or aggregator . Please check with your state for specific requirements.

  • How do I get started with State EVV?

Once you are familiar with your state requirements, order Generations EVV right from within Generations! This should be completed by an agency administrator or similar.

  • Click Admin at the top of the Home screen then select Order Generations EVV and GPS Visit Verification (You could also click Admin, Company Settings, then EVV.)
  • Select a toll free number. Click "refresh results" to see a new list of phone numbers.
  • Set an EVV  alert processing start date (which you can change later if desired,)
  • Enter your name and email address,
  • type "I agree," and
  • Click the Submit and your order is placed!

Once the order is submitted,

  • We will contact you to schedule EVV training. Be sure that your office receives EVV training. This is time to spend with a member of the Generations staff to discuss and configure EVV, as well as talk about daily operations and other features. We generally work with you weekly until data is flowing smoothly through your state interface or export.
  • Decide on a "Go Live" date - the day where Caregivers will begin calling in and out of EVV.
  • Review the EVV Data Flow .
  • Update Generations with EVV IDs for Clients and Caregivers.
  • Notify both Clients and Caregivers about EVV.
  • Go Live! On your go live date, you don't need to do anything to make EVV work. If you've done all of the things above, it is working.

Washington made the decision to implement EVV using the Open State Model. The state does not enforce any particular system(s) or recommend a particular approach. However, the system selected must meet the requirements for submitting EVV. On January 1, 2021, Washington started demanding EVV for all PCS claims.

  • The Medicaid program in Washington, known as Apple Health , can cover home care services through both a waiver program and a managed care scheme.
  • The care plan must be updated after any change in the client's condition or needs and every 12 months at a minimum.
  • When applying for employment with a home care agency in Washington, applicants must submit a fingerprint background check conducted by the DSHS.
  • It is mandatory for home care aides to finish a 75-hour training course that has been approved by the DSHS and pass the HCA certification test. Caregivers must complete 12 hours of continuing education each year to keep their certification.
  • Washington-based home care agencies must provide the clients with a legal bill of rights , ensuring quality care delivery to clients.
  • The agency must submit a fully itemized billing statement upon request, including the date of each service and the charge as per the legal bill of rights.
  • The legal bill of rights also ensures privacy and confidentiality of personal information and care-related records.
  • According to the overtime rules in Washington, caregivers will be paid at the rate of time and a half for any hours over 40 in a workweek.

You can’t use Direct File pilot if you did not live in one of the 12 participating states in 2023.

State returns in Arizona, California, Massachusetts and New York

The Direct File pilot doesn't prepare state returns. However, if you live in Arizona, California, Massachusetts or New York, the Direct File pilot guides you to a state-supported tool you can use to prepare and file your state tax return.

If you live in Washington state, Direct File guides you to a state site where you can apply for the Working Families Tax Credit when you file your federal return with the Direct File pilot.

Types of income, tax credits and deductions

You may be eligible to join the pilot if you live in a pilot state and report these items on your 2023 federal tax return:

Sign-in to Direct File securely

You'll need to verify your identity and securely sign in to file your return with the Direct File pilot.

The IRS lets you access most tax tools with one account using the same login and password. For example, if you already have an IRS online account, you can use it for the pilot. If not, you will be directed to create an account to verify your identity. Once your identity is verified, you can start preparing your return with Direct File.
