Latest COVID-19 News:

  • Dec. 6, 2021 : Starting Dec. 6, all inbound international air passengers, regardless of vaccination status, must show a negative COVID-19 test taken no more than one day before travel to the United States. This mandate does not affect domestic flights. More information and details on this international mandate can be found at the CDC .

  • July 27, 2021 : The CDC announced that fully vaccinated Americans may still be contagious and able to spread the Delta Variant of the COVID-19 virus; therefore, the CDC now urges vaccinated Americans, as well the those who are unvaccinated, to wear masks indoors in areas most impacted by high transmission rates of the Delta Variant.
  • May 19, 2021 : The Murphy administration has announced "Operation Jersey Summer," aimed at getting as many New Jerseyans ages 12+ vaccinated against COVID-19.   • May 17, 2021 : New Jersey Gov. Phil Murphy today announced the lifting of New Jersey’s travel advisory, which outlined quarantine and testing recommendations for residents and visitors to the state following interstate travel. Effective immediately, the travel advisory is no longer in place for both vaccinated and unvaccinated individuals. Residents and travelers are encouraged to follow the Centers for Disease Control and Prevention’s (CDC) protocols regarding quarantine and testing following domestic travel.  Travelers should remain up to date regarding local travel recommendations and requirements applicable to their destination. International travel is still governed by the   CDC’s protocols and guidance . New Jersey's   Travel FAQ   provides answers to many commonly asked travel questions.

Important Information:

  • Executive Order No. 253 : Effective Aug. 23, 2021, this order requires all N.J. state employees and school personnel to by fully vaccinated against COVID-19 by Oct. 18, 2021 or be subject to COVID-19 testing one-two times per week.
  • Executive Order No. 280 : Effective Jan. 11, 2022, this order declares a Public Health Emergency and restates the existing State of Emergency across all 21 counties in New Jersey, allowing state agencies and departments to utilize state resources to assist the State’s healthcare system and affected communities responding to and recovering from COVID-19 cases. Executive Order No. 281 continues Executive Orders Nos. 111, 112, and 207, allows Executive Orders Nos. 251, 252, 253, 264, and 271 to remain in effect, and extends various regulatory actions taken by the departments in response to COVID-19.

The new policy ends an 18-month ban on nonessential travel from 33 countries, including China, Brazil and European Union members. The ban had affected tourists and those hoping to visit family and friends in the U.S.

The rules reorient the U.S. approach to vetting its visitors during the pandemic.

Instead of basing entry decisions on travelers’ countries of origin, the U.S. is focusing on vaccination status.

International visitors flying into the U.S. now need to show proof of vaccination before boarding and a negative coronavirus test taken within three days of their flight.

The three vaccines available in the U.S. — Pfizer-BioNTech, Moderna and Johnson & Johnson — are accepted, as are vaccines cleared for emergency use by the W.H.O., including AstraZeneca and Covaxin.

Unvaccinated foreign visitors cannot enter the country, with limited exemptions.

Unvaccinated Americans returning home need to test negative for the coronavirus within one day of their flight and show proof they have purchased another test to take after arriving.

The hope is with these longstanding bans being lifted, the U.S. tourism industry will start to recover. The halt on travel caused a loss of nearly $300 billion in visitor spending, according to the U.S. Travel Association.

New York and Connecticut Drop Mandatory Quarantine; NJ Loosens Restrictions

Put that trip to the Finger Lakes back on the calendar—New York is dropping its mandatory quarantine.

The lingering threat of COVID-19 in New York City is still very real—and emotions raw. You’ll see locals outside, be it in playgrounds or nursing a cold beer on the sidewalk, and they have masks on and hand sanitizer at the ready. Ask anyone from the city and they’ll rattle off names of people they know who’ve been sick with coronavirus; they themselves might have had it. Which is why the former COVID-19 epicenter of the world , and by extension, the state of New York, neighboring New Jersey, and Connecticut, have cautiously reopened in lockstep together with restrictions in place.

Here’s what you need to know about travel to the tri-state area.

Do I need to quarantine or get a COVID test when traveling to and from New York?

As of April 1, New York is dropping its mandatory quarantine rule for domestic travelers coming from any other U.S. state or territory, Governor Andrew Cuomo announced . “This is great news, but it is not an all-clear for New Yorkers to let their guard down,” Cuomo said in a statement. “To beat this virus once and for all we all must continue doing what we know works to stop the spread, including wearing masks, washing our hands, and practicing social distancing.”

The NYS Department of Health still recommends you quarantine: The most recent rules stated that on arrival in New York, you should quarantine for three days. On day four, get a COVID-19 test and if the results are negative, you may exit quarantine. International travelers still face mandatory quarantine on arrival in New York. All travelers have to fill out an information form when they arrive in New York that will assist with any necessary contact tracing. Anyone exposed to COVID-19 or returning from a trip should contiue to monitor for symptoms for 14 days.

Want to visit New Jersey? Check if you need to quarantine first

New Jersey continues to discourage nonessential interstate travel, but has modified its rules for some travelers . Quarantine and testing are no longer required if you have been fully vaccinated (two weeks after your final dose) or have recovered from COVID-19 in the past three months.

Any travelers who don’t meet the above criteria and are coming to New Jersey from a states other than New York, Connecticut, Pennsylvania, and Delaware should consider taking a COVID-19 test one to three days before their trip and three to five days after. If they test positive they should self-isolate for at least 10 days; if they test negative, they will still be asked to quarantine for seven days after arrival. If travelers are unable to take a test, they should quarantine for 10 days after arrival.

Connecticut has lifted most travel restrictions

As of March 19, Connecticut’s travel restrictions are no longer mandatory . While travelers are not required to quarantine or provide a negative test when entering Connecticut, the state recommends following the CDC’s guidelines for safe travel , which include getting tested three to five days after arrival and quarantining for a full seven days.

How will the states enforce these travel restrictions?

Travelers coming into New York by air, bus, train, or car are required to fill out a Traveler Health Form prior to arrival to ensure they’re following the state’s quarantine protocols. Travelers must list their contact information and the address of where they plan to quarantine.

If you drive into New Jersey along one of its major highways (the NJ Turnpike or Garden State Parkway, for example), you may see a sign that advises you to call 511 for quarantine updates.

New Jersey Governor Phil Murphy said his state wouldn’t set up checkpoints along the state’s borders “but that the Department of Health would pursue cases of noncompliance if it became aware of them,” according to the Philadelphia Inquirer . Unvaccinated arrivals are also asked to complete an out-of-state traveler registration form .

In Connecticut, quarantine and testing is no longer mandated. Instead, the state is asking travelers to adhere to CDC recommendations.

What if I just drove or flew through a restricted state—do I still need to quarantine?

The travel advisory doesn’t apply to people passing through restricted states for a limited duration (less than 24 hours). If you’re stopping at a rest stop in a car, bus, or train, or you have a layover at an airport, you don’t need to self-quarantine, per New York and New Jersey .

For all states, it’s worth checking the latest COVID-19 information on their sites before booking anything, since the rules continue to change as vaccinations progress.

New Jersey Keeps 14-day Quarantine Rule for Travelers As New York Shifts to COVID Testing

Anyone who travels to New Jersey from a list of certain states is still required to quarantine for 14 days upon arrival.

Despite New York abandoning its 14-day quarantine COVID-19 protocol for out-of-state travelers earlier this week, neighboring New Jersey will stick to its original travel advisory plan.

New Jersey Gov. Phil Murphy announced Monday that New Jersey will continue its plan that has been in place since June to stop new coronavirus cases from entering the state. The plan initially applied to New Jersey, New York, and Connecticut.

Anyone who travels to New Jersey from a list of certain states is still required to quarantine for 14 days upon arrival. At the moment, the list includes 40 states and Puerto Rico. Despite meeting the criteria for inclusion on the list, travelers from New York, Pennsylvania and Delaware are exempt from the 14-day quarantine because of their proximity and regularity of crossing state lines.

Unlike New York's travel list rules, which could fine anyone caught breaking the rules, New Jersey had no punishment for quarantine breakers and simply asks travelers to take personal responsibility.

"We're just asking people if you don't have to travel, just flat out don't travel. Period," Gov. Murphy said in his update to the state this week.

As the country looks ahead to the holidays, Gov. Murphy announced in a tweet this week that "this won't be the year for traveling to large family gatherings" and encouraged citizens to keep their gatherings small.

New York's new travel plan requires even those with a negative COVID-19 test to quarantine for at least three days after arrival and then take a second test. If those results are also negative, travelers are free to break their quarantine.

New York is not the only state to abandon its quarantine policy for a pre-travel testing scheme. Other states, like Hawaii and Massachusetts , also allow visitors to sidestep the mandatory 14-day quarantine if they can produce negative COVID-19 results.

N.J. issues commercial vehicle travel restriction ahead of winter storm

The New Jersey Department of Transportation issued travel restrictions on commercial traffic, motorcycles, and recreational vehicles on certain interstates Saturday morning in preparation for a looming storm later in the day that could dump up to a foot of snow on parts of the state.

Starting at 2 p.m. Saturday, commercial travel along portions of highways in North Jersey will be restricted based on forecasts calling for winter weather conditions.

“Winter weather is expected to begin Saturday afternoon, which could make driving conditions treacherous, particularly in North Jersey,” the DOT said Saturday morning. “The travel restrictions are being coordinated with neighboring states. In addition to the commercial restrictions, all motorists are encouraged to avoid unnecessary travel on Saturday and Sunday.”

The restrictions will remain in effect until further notice for the following highways:

  • I-78, entire length from the Pennsylvania border to I-95 (New Jersey Turnpike)
  • I-80, entire length from the Pennsylvania border to I-95 (New Jersey Turnpike)
  • I-280, entire length from I-80 to I-95 (New Jersey Turnpike)
  • I-287, entire length from NJ Route 440 to the New York State border
  • NJ Route 440, from the Outerbridge Crossing to I-287

According to the DOT, commercial vehicles include:

  • All tractor-trailers except those providing essential public services
  • Empty straight CDL-weighted trucks
  • Passenger vehicles pulling trailers
  • Recreational vehicles
  • Motorcycles

The restrictions do not apply to several other state highways such as the New Jersey Turnpike, Garden State Parkway, and Atlantic City Expressway.

The DOT advises trucks that are already traveling in the state by the time of the restrictions to pull into rest stops to wait out the storm and to avoid pulling over onto the shoulder.

  • Until further notice, the taxi stand at John F. Kennedy International Airport’s Terminal 5 has been relocated to the ground level of Terminal 5’s Yellow Parking Garage. Passengers seeking taxi transportation from Terminal 5 are directed to the Yellow Garage via the skywalk on the fifth floor, where passengers may access the new taxi stand using elevators or stairs. Wayfinding signage has been installed along the pedestrian route.
  • Until further notice, parking on level 1 of John F. Kennedy International Airport’s Yellow Parking Lot at Terminal 5 is now dedicated for individuals with special needs or disabilities. For customer assistance, parking attendants are available on level 1. All other vehicles must park on levels 2 to 6. Premium Reserved Parking is available on level 5, which is easily accessible to Terminal 5 via the pedestrian skywalk. Electric vehicle charging is available on level 2. Plan ahead by checking parking availability and booking a parking spot in advance .
  • As a reminder, all rental car companies serving Newark Liberty International Airport now operate out of the new consolidated rental car center that is co-located within the Parking A garage on levels 1 through 3. All rental transactions, including returns, take place at the new center. The facility is connected to Newark Liberty’s terminals B and C via AirTrain Newark, with a direct connection to Terminal A via a pedestrian bridge. Passengers exiting Terminal A can walk across the bridge to arrive on level two of the rental car facility. Drivers should follow “Rental Car Return” roadway signage. For more information, click
  • As a reminder, peak period parking rates are now in effect at John F. Kennedy International, Newark Liberty International and LaGuardia airports. To manage on-airport parking demand, the Port Authority is urgently calling on air travelers to use mass transit and to pre-book parking spaces if they plan to travel to the airport by private car. Travelers who do not pre-book will be charged a peak period drive-up surcharge and may not be able to find a parking spot at the airport. To avoid paying a higher parking rate and guarantee a parking spot, travelers parking for longer than three hours are strongly encouraged to pre-book parking at least 24 hours in advance.   • LaGuardia Link Q70 bus service is fare free year-round to encourage the use of public transit to and from LaGuardia Airport, as announced in April 2022 by New York Gov. Kathy Hochul.   • On Saturday, April 13, from 6 a.m. to 11:59 p.m., World Trade Center-bound and Hoboken/33 St.-bound PATH trains will bypass the Grove St. station to accommodate extensive station rehabilitation work. During this time, Newark-Penn Station-bound and Journal Square-bound trains will continue to make stops at Grove St. Weekday service at Grove St. will not be affected.   • For World Trade Center-bound or Hoboken/33 St.-bound service from Grove St: Customers can take a Journal Square-bound or Newark-Penn Station-bound train to Journal Square and transfer to a World Trade Center-bound or 33 St.-bound train. Alternatively, customers can begin their trip at nearby Exchange Pl. or Newport stations.
  • For service from Newark-Penn Station, Harrison, or Journal Square to Grove St.: From Newark-Penn Station and Harrison, customers can take a World Trade Center-bound train to Exchange Pl., and transfer to a Newark-Penn Station-bound train to ride back to Grove St. From Journal Square, customers can either take a Hoboken/33 St.-bound train to Newport and transfer to a Journal-Square-bound train to ride back to Grove St., or take a World Trade Center-bound train to Exchange Pl. and transfer to a Newark-Penn Station-bound train to ride back to Grove St.
  • Customers who use the PATH World Trade Center station during overnights should use the street level entrances at Fulton Street or Vesey Street via the North Concourse in the 2 World Trade Center transit lobby. Oculus access is limited overnight from 1 a.m. to 5 a.m. to allow for enhanced cleaning and the safety and security of customers due to reduced traffic volumes. All other entrances will be closed. NEW YORK CITY (WPVI) -- Officials in New Jersey and Pennsylvania have issued some travel restrictions due to the winter storm.

NEW JERSEY RESTRICTIONS

Department of Transportation (NJDOT) Commissioner Diane Gutierrez-Scaccetti has issued a commercial vehicle travel restriction on multiple Interstate highways in New Jersey based on the forecast for heavy snow and strong winds.

The travel restrictions are being coordinated with neighboring states.

In addition to the commercial restrictions, all motorists are strongly encouraged to stay off the roads, particularly Sunday night and Monday. The safest place to be is at home.

The commercial vehicle travel restriction that began at noon on Sunday will be in place for the length of the following highways in both directions:

I-76, from the Walt Whitman Bridge (Pennsylvania border) to NJ Route 42

I-78, from the Pennsylvania border to I-95 (New Jersey Turnpike)

I-80, from the Pennsylvania border to I-95 (New Jersey Turnpike)

I-195, from I-295 to NJ Route 138

I-280, from I-80 to I-95 (New Jersey Turnpike)

I-287, from NJ Route 440 to the New York State border

I-295, from the Delaware Memorial Bridge to the Scudders Falls Bridge (Pennsylvania border)

I-676, from the Benjamin Franklin Bridge (Pennsylvania border) to I-76

NJ Route 440, from the Outerbridge Crossing to I-287

The commercial vehicle travel restriction applies to:

All tractor-trailers (exceptions as listed in the Administrative Order)

Empty straight CDL-weighted trucks

Passenger vehicles pulling trailers

Recreational vehicles

Motorcycles

This restriction DOES NOT apply to:

The New Jersey Turnpike

The Garden State Parkway

The Atlantic City Expressway

Public safety vehicles, sworn and civilian public safety personnel; as well as other personnel directly supporting healthcare facilities or critical infrastructure such as providing fuel or food. Trucks that are already in New Jersey when the travel restrictions go into place are encouraged to pull off in truck stops to wait out the storm - DO NOT PARK ON SHOULDERS.

New Jersey has activated more than 3,000 plows and salt spreaders ready to clear state highways.

Residents and motorists should avoid driving unless you are an essential employee needed for emergency response. If you do not have to be on the roads during the storm, stay home. If you must drive, do so carefully and plan your trips accordingly, road conditions can change in an instant.

Snow emergencies and closings throughout the Philadelphia region

If you see crews on the roads, please stay back and do not pass them. They are clearing the roadways for your safety. If you have to drive, NJDOT advises motorists to:

Leave early and allow extra time

Make sure your vehicle is fully fueled

SLOW DOWN, and obey posted speed limits

Leave a safe following distance between vehicles

Use caution on bridges and ramps

Always STAY CLEAR of plowing and spreading trucks. If they are behind you, let them pass

DO NOT pass between trucks that are in a plow formation

If you are driving and road conditions deteriorate, PULL OFF somewhere safe and wait it out

Be patient and use caution

Keep an emergency kit in your car with a cell phone charger, water, snacks and other items. See the NJ Office of Emergency Managements web site for more information.

Motorists are encouraged to check NJDOT's traffic information website www.511nj.org for real-time travel information.

PENNSYLVANIA RESTRICTIONS

In response to winter weather conditions throughout Bucks, Chester, Delaware, Montgomery and Philadelphia counties, the Pennsylvania Department of Transportation (PennDOT) will implement Tier 1 of the commonwealth's weather event vehicle restriction plan on all interstates in the Philadelphia Region at 2:00 PM. This includes the following roadways: I-76, I-95, I-295, I-476 and I-676.

Under Tier 1 restrictions, the following vehicles are not permitted on affected roadways:

- Tractors without trailers

- Tractors towing unloaded or lightly loaded enclosed trailers, open trailers or tank trailers

- Tractors towing unloaded or lightly loaded tandem trailers

- Enclosed cargo delivery trucks that meet the definition of a CMV

- Passenger vehicles (cars, SUV's, pickup trucks, etc.) towing trailers

- Recreational vehicles/motorhomes

- School buses, commercial buses and motor coaches not carrying chains or Alternate Traction Devices (ATD's)

- Motorcycles

A 45-mph speed restriction remains in effect on the interstates mentioned above as well as the following major roads:

U.S. Routes 1, 30, 202, 422; and

State Routes 63, 100 Spur and 309.

The vehicle and speed restrictions will remain in place until conditions warrant their removal.

Here are the 15 best places to visit in New Jersey:

Ocean city boardwalk.

Known for amusement rides and arcade games that accommodate all ages, Ocean City boardwalk is a fun-filled destination for the the whole family. “The Ocean City Boardwalk is a famous promenade that’s been a source of entertainment for more than 100 years," Wieland said.

This charming Jersey Shore town set on peninsula is a year-round destination with family-friendly and various oceanside dining.

Morey's Piers & Beachfront Water Parks

“Families can spend the entire day on more than 100 rides, splashing around the two water parks right on the beach, and lounging in private cabanas,” Vasser said.

Wildwoods Boardwalk

Composed of more than 70,000 wooden planks, the 38-block oceanfront stretch draws crowds with everything from amusement rides, games, water parks and more.

Wildwood’s Doo Wop Motel District

The largest concentration of mid-century motels in the country has over 50 vintage motels still stand today within this unique district. “It’s really neat to see all the neon signs and retro details. Walking around Wildwood’s Doo Wop Motel District is like being transported to the 1950s,” said Vasser.

American Dream

American Dream is the second-largest shopping mall in the United States, and includes restaurants and themed parks that provide endless fun for the whole family. “American Dream is, quite literally, an indoor vacation one-stop shop that’s open year-round,” said Vasser.

Lambertville

Full of rich history, Lambertville has well-preserved federal townhouses, Victorian homes and antique shops that brings history to life. “The charming town also supplies family-owned wineries and photogenic vantage points such as Goat Hill Overlook,” added Vasser.

Beneduce Vineyards

This 77-acre farm with 25 acres of vines are hand pruned, hand harvested and dry farmed in the rolling hills of Hunterdon County. “One of my favorites, Beneduce Vineyards, has great wine and fun year-round events such as live music and food trucks on Saturdays,” said Vasser.

Grounds for Sculpture

Grounds for Sculpture is a 42-acre landscaped park with 300 contemporary sculptures, an arboretum, and a museum with an indoor exhibitions that features six galleries.

Atlantic City

Known as the East Coast's version of Las Vegas offers travelers casinos, live entertainment, big-name restaurants with more fun attractions at the Steel Pier and the only helicopter ride at the Jersey Shore.

Frenchtown is a vibrant community full of Victorian architecture, art, and culture nestled along the banks of the Delaware River. Vasser recommends visiting during Frenchtown Riverfest. “There are all kinds of street fair activities along the river,” he said.

Cape May County Park & Zoo

The Cape May County Park & Zoo houses over 500 different animals that includes African lions, American black bears, snow leopards and ring-tailed lemurs. The zoo features playgrounds for kids of all ages and both places are free to the public. "It's truly one of the best-kept secrets in the area," said Wieland.

Asbury Park

Asbury Park has become a creative hub and music mecca within the last decade with iconic landmarks like The Stone Pony, Asbury Lanes and Silverball Retro Arcade. Asbury Park combines gaming, bowling, dining, live entertainment and of course swimming and surfing on the shore.

Adventure Aquarium

Adventure Aquarium features the largest collection of sharks on the East Coast and protects over 8,000 aquatic species, including penguins and stingrays. Visitors can interact with hundreds of sea creatures at the touch tanks. “It’s a favorite for kids of all ages, especially if you’re looking for an indoor activity,” said Wieland.

Long Beach Island

The shores of Long Beach Island are particularly lovely. Besides its scenic Atlantic Ocean coastline, vacationers go for the water sports, charming towns like Barnegat Light, and the laid-back lifestyle.

Arizona Supreme Court rules a near-total abortion ban from 1864 is enforceable

PHOENIX — The Arizona Supreme Court ruled Tuesday that a 160-year-old near-total abortion ban still on the books in the state is enforceable, a bombshell decision that adds the state to the growing lists of places where abortion care is effectively banned.

The ruling allows an 1864 law in Arizona to stand that made abortion a felony punishable by two to five years in prison for anyone who performs one or helps a woman obtain one. 

The law — which was codified in 1901, and again in 1913 — outlaws abortion from the moment of conception but includes an exception to save the woman’s life.

That Civil War-era law — enacted a half-century before Arizona even gained statehood — was never repealed and an appellate court ruled last year that it could remain on the books as long as it was “harmonized” with a 2022 law, leading to substantial confusion in Arizona regarding exactly when during a pregnancy abortion was outlawed.

The decision — which could shutter abortion clinics in the state — effectively undoes a lower court’s ruling that stated that a more recent 15-week ban from March 2022 superseded the 1864 law.

The Arizona Supreme Court said it would put its decision on hold for 14 days, writing that it would send the case back to a lower court so that court could consider “additional constitutional challenges” that haven’t yet been cleared up.

Attorney General Kris Mayes, a Democrat, said moments after the ruling that she would not enforce the law.

“Let me be completely clear, as long as I am Attorney General, no woman or doctor will be prosecuted under this draconian law in this state,” Mayes said in a statement, adding that the decision was “unconscionable” and “an affront to freedom.”

Democrats all the way up to President Joe Biden also blasted the ruling.

“Millions of Arizonans will soon live under an even more extreme and dangerous abortion ban, which fails to protect women even when their health is at risk or in tragic cases of rape or incest,” Biden said in a statement. He called the ban “cruel” and “a result of the extreme agenda of Republican elected officials who are committed to ripping away women’s freedom” and vowed to “continue to fight to protect reproductive rights.”

Vice President Kamala Harris announced shortly after the ruling that she would travel to Arizona on Friday “to continue her leadership in the fight for reproductive freedoms."

Responding to questions from NBC News about the Arizona ruling, a spokesperson for Donald Trump's campaign referred only to the former president's comments on Monday that abortion restrictions should be left to states.

“President Trump could not have been more clear. These are decisions for people of each state to make," Trump campaign national press secretary Karoline Leavitt said.

Arizona Gov. Katie Hobbs called for the GOP-controlled Legislature, which is currently in session, to repeal the 1864 ban, though there was no immediate indication that Republican lawmakers in either chamber would take up such an effort.

"We are 14 days away from this extreme ban coming back to life," Hobbs, a Democrat, said at a press conference. "It must be repealed immediately."

While Hobbs said she was "sure" reproductive rights advocates would appeal the ruling in the 14-day window they were given, she also suggested that the best avenue to counter the ruling would be for voters to support abortion rights on the November ballot. A separate, ongoing suit would allow for abortion providers to continue providing services through the 15th week of pregnancy for another 45 days.

"It is more urgent than ever that Arizonans have the opportunity to vote to enshrine the right to abortion in our constitution this November. I’m confident that Arizonans will support this ballot measure, and I’m going to continue doing everything in my power to make sure it is successful," Hobbs said.

In a 4-2 ruling, the court’s majority concluded that the 15-week ban “does not create a right to, or otherwise provide independent statutory authority for, an abortion that repeals or restricts” the Civil War-era ban “but rather is predicated entirely on the existence of a federal constitutional right to an abortion since disclaimed” by the 2022 Dobbs decision that overturned Roe v. Wade.

“Absent the federal constitutional abortion right, and because” the 2022 law "does not independently authorize abortion, there is no provision in federal or state law prohibiting” the 1864 ban.

They added that the ban “is now enforceable.”

Tuesday’s ruling is the latest chapter in a decadeslong saga of litigation in the battleground state over abortion rights. 

Reproductive rights groups had sued to overturn the 19th century law in 1971. But when the Roe decision came down in 1973, a lower state court ruled against those groups and placed an injunction on the 1864 ban that remained in effect until the Dobbs decision.

In March 2022, Republican lawmakers in the state enacted the 15-week trigger ban, which, months later — after the Dobbs decision — snapped into effect. The law makes exceptions for medical emergencies but not for rape or incest. 

Litigation resumed after that decision as lawmakers on both sides of the issue sought clarity on whether to enforce the 1864 near-total ban or the 2022 15-week ban.

A state appellate court initially ruled that both the 1864 and 2022 laws could eventually be “harmonized,” but also said that the 15-week ban superseded the near-total abortion ban and put on hold large parts of the older law.

The decision also sent shockwaves through the reproductive rights community in Arizona and nationally.

Angela Florez, the president of Planned Parenthood Arizona, one of the state's remaining abortion care providers, said her group would now only be able to provide abortion care through the 15th week of pregnancy — and only "for a very short period of time."

The issue, however, could soon be in the hands of voters.

Abortion rights groups in the state are likely to succeed in their goal of putting a proposed constitutional amendment on the November ballot that would create a “fundamental right” to receive abortion care up until fetal viability, or about the 24th week of pregnancy.

If voters approved the ballot measure, it would effectively undo the 1864 ban that now remains law in the state. It would bar the state from restricting abortion care in situations where the health or life of the pregnant person is at risk after the point of viability, according to the treating health care professional.

That ballot effort is one of at least 11 across the country that seek to put the issue directly in the hands of voters — a move that has the potential to significantly boost turnout for Democratic candidates emphasizing the issue. 

In 2024, that could factor heavily into the outcome of both the presidential and U.S. Senate races in Arizona. Biden, whose campaign is leaning heavily into reproductive rights, won the state by just over 10,000 votes four years ago. And the Senate race features a tough battle to fill the seat held by the retiring independent Sen. Kyrsten Sinema, most likely between Democrat Ruben Gallego and Republican Kari Lake. 

During her unsuccessful 2022 run for governor in Arizona, Lake said she supported the 1864 law, calling it “ a great law that’s already on the books .” But Lake now says she opposes the 1864 law , as well as a federal abortion ban, while also acknowledging that her own views regarding state policy conflict with some voters’ preferences.

In a statement following the decision, Lake said she opposed the ruling, adding that "it is abundantly clear that the pre-statehood law is out of step with Arizonans." She called on state lawmakers to "come up with an immediate common sense solution that Arizonans can support."

"Ultimately, Arizona voters will make the decision on the ballot come November," she added. 

Gallego, who is backed by several reproductive rights groups, has said he supports the ballot measure. As a member of the U.S. House, he is among the co-sponsors of the Women’s Health Protection Act, which would create federal abortion protections.

In a video posted to X after the ruling, Gallego said he would, with reproductive rights supporters, "fight all the way to November so we can get abortion rights back for women in Arizona."

Other Republicans in the state who’d previously expressed robust support for Roe being overturned joined Lake in condemning the ruling. Reps. Juan Ciscomani and David Schweikert , who both face tough re-elections this fall, both called on state lawmakers to address the issue “immediately.”

The ruling Tuesday — the second in a swing state on the issue in as many weeks — further highlights the already prominent role abortion rights will play in Arizona and across the country.

Last week, the Florida Supreme Court upheld a 15-week ban on abortion in the state, which effectively meant that a six-week abortion ban, with exceptions for rape, incest and the life of the woman, that Gov. Ron DeSantis signed into law last year will take effect. The state's high court also allowed a proposed amendment that would enshrine abortion protections in the state constitution to appear on the November ballot.

Tuesday's decision, while jarring to reproductive rights groups, wasn’t entirely unexpected. All seven justices on the Arizona Supreme Court were appointed by Republican governors, and during opening arguments in December, they aggressively, but civilly, quizzed attorneys on both sides about the fact that the 15-week ban enacted last year did not feature any language making clear whether it was designed to repeal or replace the 1864 ban.

Only six justices participated in Tuesday’s decision, however, after Justice Bill Montgomery — who previously accused Planned Parenthood of practicing “generational genocide” — recused himself. (The court’s chief justice did not appoint another judge to take the spot, which is an option under Arizona law.)

The abortion landscape in Arizona has been uniquely confusing since Roe v. Wade was overturned. 

While the 1864 law had been on hold after the Supreme Court’s 1973 Roe decision, then-Arizona Attorney General Mark Brnovich, a Republican, successfully sued in 2022 to have that injunction lifted following the overturning of Roe, putting the ban back into effect — though a higher court put that ruling on hold. 

But after Mayes succeeded Brnovich as attorney general, she announced that she would not enforce the 1864 ban.

That led to suits from anti-abortion groups seeking enforcement of the ban, which ultimately led to the case making its way up to the state Supreme Court.
